Court D-Day for 
Governor Mutua

High court judge Isaac Lenaola has granted Governor Alfred Mutua till February to know the fate of a corruption case hanging around his neck.

Isaac Lenaola​ set February 5 2016 as the day he rules on whether or not the Govenor of Machakos will be brought to account over the alleged improper acquisition of executive fleet for himself and his ministers in 2013.
Lenaola's order amounts to a review of some sorts of an earlier order he had made when he said " the court could not exercise its discretion in setting aside orders to assist a person  who has deliberately sought to abstruct or delay the course of justice", exposing Dr Mutua to arrest, which prompted him to return to court to seek to halt the imminent arrest and prosecution.
Director of Public Prosecutions Keriako Tobiko and the Ethics and Anti Corruption Commission are pursuing Dr Mutua, saying he has enjoyed court protection for far too long.
After listening to pleadings by lawyer Wilfred Nyamu, Lenaola said ..." It will defeat the purpose of my intended ruling if adverse action is taken against Mutua"
Mutua is pleading that he neither is a signatory in any procurement process and that officials involved in the process have already been charged over the alleged improprieties.
